The Lord Chancellor, in exercise of the powers conferred on him by section 100(2) of the Land Registration Act 2002[1], hereby makes the following Regulations - Citation and commencement 1. These Regulations may be cited as the Land Registration (Acting Chief Land Registrar) Regulations 2003 and shall come into force on 13th October 2003. Appointment 2. - (1) The Lord Chancellor may appoint a person to carry out the functions of the registrar during any vacancy in that office. (2) The person appointed under paragraph (1) must, at the time of appointment, be a member of the land registry and also a member of the Senior Civil Service. (3) Subject to paragraph (4), the person appointed shall carry out the functions of the registrar during any vacancy. (4) An appointment under paragraph (1) shall cease if the person appointed -
(b) resigns his appointment under paragraph (1) by giving notice in writing to the Lord Chancellor, or (c) has his appointment revoked by the Lord Chancellor on the grounds of being unable or unfit to discharge the functions of the registrar.
(5) For the purpose of paragraph (2), a person is to be treated as a member of the Senior Civil Service if, at the time of his appointment, he holds a Civil Service grade which is, or is equivalent to, a grade at any time covered by the Senior Civil Service. (This note is not part of the Regulations) The Land Registration Act 2002 makes provision about land registration and in particular provides for the appointment of the Chief Land Registrar. These Regulations make provision for the carrying out of the Chief Land Registrar's functions during any vacancy in that office. Regulation 2 makes provision for the appointment.
