The Potatoes Originating in Egypt (Amendment) Regulations (Northern Ireland) 2001

  Made 31st January 2001 
  Coming into operation 5th March 2001 

The Department of Agriculture and Rural Development being a Department designated[1] for the purposes of section 2(2) of the European Communities Act 1972[2] in relation to the common agricultural policy of the European Community, in exercise of the powers conferred on it by the said section 2(2) and of every other power enabling it in that behalf, hereby makes the following Regulations:

Citation, commencement and interpretation
     1.  - (1) These Regulations may be cited as the Potatoes Originating in Egypt (Amendment) Regulations (Northern Ireland) 2001 and shall come into operation on 5th March 2001.

    (2) The Interpretation Act (Northern Ireland) 1954[
3] shall apply to these Regulations as it applies to an Act of the Northern Ireland Assembly.

Amendment of the Potatoes Originating in Egypt Regulations (Northern Ireland) 1998
     2.  - (1) The Potatoes Originating in Egypt Regulations (Northern Ireland) 1998[4] shall be amended in accordance with paragraphs (2) and (3).

    (2) In regulation 2(1) (Interpretation) for the definition of "the Decision" there shall be substituted - 

      " "the Decision" means Commission Decision 96/301/EC authorising member States temporarily to take additional measures against the dissemination of Pseudomonas solanacearum (Smith) Smith as regards Egypt[5] as amended by the instruments listed in the Schedule to these Regulations;".

    (3) After regulation 6 there shall be inserted the Schedule set out in the Schedule to these Regulations.

New Schedule to the Potatoes Originating in Egypt Regulations (Northern Ireland) 1998







EXPLANATORY NOTE

(This note is not part of the Regulations.)


These Regulations implement in Northern Ireland Commission Decision 2000/568/EC (O.J. No. L.238, 22.9.2000, p. 59) amending Decision 96/301/EC authorising member States temporarily to take emergency measures against the dissemination of Pseudomonas solanacearum (Smith) Smith as regards Egypt.

The Regulations amend the definition of "the Decision" in the Potatoes Originating in Egypt Regulations (Northern Ireland) 1998 (regulation 2(1)). Commission Decision 2000/568/EC renews the framework within which potatoes may be imported from Egypt into the territory of the European Community.

No regulatory appraisal has been prepared in respect of these Regulations.
