Sweeteners in Food (Amendment) Regulations (Northern Ireland) 1999

  Made 5th May 1999  
  Coming into operation 14th June 1999  

The Department of Health and Social Services in exercise of the powers conferred on it by Articles 15(1)(a) and (e), 16(1), 25(1) and (3), 26(3) and 47(2) of, and paragraph 1 of Schedule 1 to, the Food Safety (Northern Ireland) Order 1991[1] and of all other powers enabling it in that behalf and after consultation in accordance with Article 47(3) of that Order with such organisations as appear to it to be representative of interests likely to be substantially affected by the Regulations, hereby makes the following Regulations:

Citation, commencement and interpretation
     1.  - (1) These Regulations may be cited as the Sweeteners in Food (Amendment) Regulations (Northern Ireland) 1999 and shall come into operation on 14th June 1999.

    (2) In these Regulations "the principal Regulations" means the Sweeteners in Food Regulations (Northern Ireland) 1996[
2].

Amendment of the principal Regulations
     2. The principal Regulations shall be amended by the addition, at the end of the definition of "Directive 95/31/EC" in regulation 2(1), of the words "as amended by Directive 98/66/EC[3]".

Consequential provision
     3.  - (1) References to the principal Regulations in the provisions listed in paragraph (2) shall be taken to be references to the principal Regulations as amended up to and including the amendment effected by these Regulations.

    (2) The provisions to which paragraph (1) refers are - 

    (a) the definition of "permitted sweetener" in regulation 2(1) (interpretation) of the Jam and Similar Products Regulations (Northern Ireland) 1982[4];

    (b) the definition of "additive" in regulation 2(1) (interpretation) of the Meat Products and Spreadable Fish Products Regulations (Northern Ireland) 1984[5];

    (c) the definition of "sweetener" in Part II of Schedule 1 (categories of food additives) to the Food Additives Labelling Regulations (Northern Ireland) 1992[6];

    (d) the definition of "sweetener" in regulation 2(1) (interpretation) of the Miscellaneous Food Additives Regulations (Northern Ireland) 1996[7]; and

    (e) in the Food Labelling Regulations (Northern Ireland) 1996[8] - 

      (i) paragraph (1) of regulation 34 (foods containing sweeteners, added sugar and sweeteners, aspartame or polyols); and

      (ii) in Schedule 8 (misleading descriptions), in Part I (general), the condition in column 2 opposite the description "ice cream" in column 1.

EXPLANATORY NOTE

(This note is not part of the Regulations.)


These Regulations further amend the Sweeteners in Food Regulations (Northern Ireland) 1996 ("the principal Regulations") by bringing up to date a reference to Directive 95/31/EC on specific purity criteria so as to cover its amendment by Directive 98/66/EC, which changed the specification for isomalt and by bringing up to date references to the principal Regulations in other Regulations.
