FISHERIES

Fisheries (Amendment) Byelaws (Northern Ireland) 2001

  Made 18th December 2001 
  Coming into operation 1st January 2002 

The Fisheries Conservancy Board for Northern Ireland, in exercise of the powers conferred on it by sections 26(1), 37(1), 89, and 95 of the Fisheries Act (Northern Ireland) 1966[1] and of every other power enabling it in that behalf, with the approval of the Department of Culture, Arts and Leisure[2], hereby makes the following Byelaws:

Citation and commencement
     1. These Byelaws may be cited as the Fisheries (Amendment) Byelaws (Northern Ireland) 2001 and shall come into operation on 1st January 2002.

Amendment of the Fisheries Byelaws (Northern Ireland) 1997
    
2. The Fisheries Byelaws (Northern Ireland) 1997[3] shall be amended as provided in Byelaws 3 to 6.

Interpretation
     3. In Byelaw 2(1) after the definition of "defined mouth" there shall be inserted the following definition - 

Annual close season for angling for salmon or trout
     4. After Byelaw 71 there shall be inserted the following Byelaw - 

Licences, duties and fees
    
5. In Part I of Schedule 1 (licences to fish with rod and line and hand line) at the end there shall be inserted the following entries - 

"Disabled angler's season game fishing rod licence
9·50
Disabled angler's season coarse fishing rod licence
3·50"


List of waters where there is no close season for rainbow trout
    
6. For Schedule 4 there shall be substituted the following Schedule -

EXPLANATORY NOTE

(This note is not part of the Byelaws.)


These Byelaws amend the Fisheries Byelaws (Northern Ireland) 1997 ("the principal Byelaws").

The principal changes are as follows:

    
1. Byelaw 4 reinserts Byelaw 72 (annual close season for angling for salmon, trout, and rainbow trout) into the principal Byelaws. Byelaw 72 was previously revoked by the Fisheries (Amendment No. 3) Byelaws (Northern Ireland) 2000 (S.R. 2000 No. 364).

    
2. Byelaws 3 and 5 introduce new fishing rod licences, and the duties that apply to them, for disabled anglers.

    
3. Byelaw 6 substitutes a new Schedule for Schedule 4 to the principal Byelaws (list of rainbow trout waters where there is no annual close season for angling for rainbow trout). Islandderry Lake, Dromore Road, Lurgan, Ballywillwill Lake, Annsborough, Lough Money, Portavoe Reservoir, The Egg Cup, Dundrum and 194 Caledon Road, Aughnacloy are added to the list of rainbow trout waters in the Schedule. Potterswall Reservoir, Gibson's Lough, and Rectory Lodge Trout Fishery are reinserted into the Schedule following the revocation made by S.R. 2000 No. 364. The rainbow trout water listed as Magherascouse Road, Ballygowan, is renamed as Hazelwood Rainbow Trout Fishery.
