FISHERIES

Fisheries (Amendment No. 3) Byelaws (Northern Ireland) 2000

  Made 24th November 2000 
  Coming into operation 1st January 2001 

The Fisheries Conservancy Board for Northern Ireland in exercise of the powers conferred on it by sections 26(1)[1], 37(1)[2] to (3), 51(2), 52(2), 70(1) and (2), 71(2)(g), 72(1), 89, 95(1) and (2), 97, 114(1)(b) and 115(1)(b)[3] of the Fisheries Act (Northern Ireland) 1966[4] and of every other power enabling it in that behalf, with the approval of the Department of Culture, Arts and Leisure[5], hereby makes the following Byelaws: - 

Citation and commencement
     1. These Regulations may be cited as the Fisheries (Amendment No. 3) Byelaws (Northern Ireland) 2000 and shall come into operation on 1st January 2001.

Amendment of the Fisheries Byelaws (Northern Ireland) 1997
    
2. The Fisheries Byelaws (Northern Ireland) 1997[6] shall be amended as provided in Byelaws 3 and 4.

List of waters where there is no Close Season for Rainbow Trout
     3. In Schedule 4 in the list of rainbow trout waters where there is no annual close season for angling of rainbow trout - 

    (a) under the heading County Antrim there shall be inserted after the reference to "Cornmill Fishery" a reference to "Craigmore Fishery, Randalstown", and

    (b) under the heading County Down there shall be inserted after the reference to "Magheralagan Lake" a reference to "Magherascouse Road, Ballygowan", and

    (c) under the heading County Londonderry there shall be inserted after the reference to "Loughinsholin Put and Take Fishery" a reference to "Moorbrook Lodge, Castlerock".

     4. For Schedule 1 there shall be substituted the following Schedule:

5. The Fisheries (Amendment No. 2) Byelaws (Northern Ireland) 1999[7] are hereby revoked.

EXPLANATORY NOTE

(This note is not part of the Byelaws.)


These Byelaws amend the Fisheries Byelaws (Northern Ireland) 1997. The principal changes are as follows:

    
1. These Byelaws designate the number of waters as rainbow trout waters for the purposes of Byelaw 76 of the Fisheries Byelaws (Northern Ireland) 1997 ("The principal Byelaws") which provides that there shall be no close season for angling for rainbow trout in waters so designated. (Byelaw 3)

    
2. The Byelaws increase the licence duties payable from 1st January 2001 for fishing with rod and line and hand line for salmon and freshwater fish and for commercial fishing engines used for the taking of salmon and freshwater fish other than eels together with the fee payable for a licence which authorises the holder to buy and sell salmon, trout and eels. (Byelaw 4)
