ANIMALS

Animals (Records) (Amendment) Order (Northern Ireland) 2000

  Made 14th November 2000  
  Coming into operation 1st January 2001  

The Department of Agriculture and Rural Development[1], in exercise of the powers conferred on it by Articles 44 and 60(1) of the Diseases of Animals (Northern Ireland) Order 1981[2] and of every other power enabling it in that behalf, hereby makes the following Order:

Citation and commencement
1. This Order may be cited as the Animals (Records) (Amendment) Order (Northern Ireland) 2000 and shall come into operation on 1st January 2001.

Amendments to the Animals (Records) Order (Northern Ireland) 1997
2.  - (1) The Animals (Records) Order (Northern Ireland) 1997[3] shall be amended as provided in paragraphs (2) to (4).

    (2) After Article 4(3) there shall be inserted the following paragraph - 
 

        " (3A) Without prejudice to paragraphs (2) and (3), the owner or person in charge of sheep shall record, on or before 31st January in each year, the particulars specified in columns G to L of the form set out in Schedule 3 in respect of sheep owned by him or in his charge on 1st January of that year.".
     
    (3) In both Article 5(1) and Article 6 after "4(1), (2)" there shall be inserted, ", (3A)".

    (4) For Schedule 3 (flock record for sheep) there shall be substituted the Schedule set out in the Schedule to this Order.

Transitional provision
    3. Any entry made in a record in respect of sheep required to be kept by a person by the Animals (Records) Order (Northern Ireland) 1997 as it had effect on 31st December 2000, shall, if made on or before 31st December 2000, be retained by him for a period of 3 years after the making of the last entry in the record and the provisions of Article 7(4) of that Order relating to the production, inspection and taking of extracts shall apply to that entry until the expiration of that period of 3 years.

EXPLANATORY NOTE 

(This note is not part of the Order.)


This Order amends the Animals (Records) Order (Northern Ireland) 1997 which implements the record keeping requirements in respect of sheep of Council Directive 92/102/EEC on the identification and registration of animals (O.J. No. L355, 5.12.92, p. 32) by - 
 

    (a) requiring the owner or person in charge of sheep to record, on or before 31st January in each year, particulars of sheep owned by him or in his charge on 1st January of that year;

    (b) replacing Schedule 3 (flock record for sheep) with a new Schedule setting out a new format for the recording of sheep.
     

    Article 3 contains a transitional provision.
