The Secretary of State for Environment, Food and Rural Affairs, being
designated[1] for the purposes of section 2(2) of the
European Communities Act 1972[2] in relation to the Common
Agricultural Policy of the European Community, in exercise of the powers
conferred on her by that section, and of all other powers enabling her
in that behalf, makes the following Regulations:
Title, commencement and extent
1. These Regulations may be cited
as the Foot-and-Mouth Disease (Marking of Meat, Meat Products, Minced Meat
and Meat Preparations) (No. 2) Regulations 2001; they extend to England
and come into force on 20th July 2001.
Amendments
2. The date "23rd September 2001" shall be substituted
for the date "23rd July 2001" in the following provisions -
(a) paragraph 3A(3) of Part VI of Schedule 2 to the Meat Products
(Hygiene) Regulations 1994[3];
(b) regulation 7(7) and regulation 8(8) of the Minced Meat and Meat
Preparations (Hygiene) Regulations 1995[4]; and
(c) paragraph 3 of Part I of Schedule 13 to the Fresh Meat (Hygiene
and Inspection) Regulations 1995[5].

EXPLANATORY NOTE
(This note is not part of the Regulations)
Commission Decision 2001/304/EC and Commission Decision 2001/345/EC
permit dual health marking of meat, minced meat, meat preparations and
meat products for a transitional period.
For meat, these Decisions are implemented in England by the Foot-And-Mouth
Disease (Marking of Meat and Meat Products) Regulations 2001 (S.I. 2001/1512)
which amend the Fresh Meat (Hygiene and Inspection) Regulations 1995 (S.I.
1995/539).
For meat products, they are implemented in England by the Foot-And-Mouth
Disease (Marking of Meat and Meat Products) Regulations 2001 which amend
the Meat Products (Hygiene) Regulations 1994 (S.I. 1994/3082).
For minced meat and meat preparations, the Decisions are implemented
in England by the Foot-And-Mouth Disease (Marking of Meat, Minced Meat
and Meat Preparations) Regulations 2001 (S.I. 2001/1739) which amend the
Minced Meat and Meat Preparations (Hygiene) Regulations 1995 (S.I. 1995/3205).
In all cases, the transitional period ends on 23rd July 2001. The
date does not appear in the Commission Decisions.
These Regulations extend the transitional period to 23rd September
2001.
A Regulatory Impact Assessment has not been prepared for these Regulations.
