The Scottish Ministers, in exercise of the powers conferred by section 2(2) of the European Communities Act 1972[1] and, in respect of regulation 3 of the following Regulations, in exercise of the powers conferred by section 56(1) and (2) of the Finance Act 1973[2], hereby make the following Regulations: Citation, commencement and extent 1. - (1) These Regulations may be cited as the Plant Protection Products Amendment (No. 2) (Scotland) Regulations 2001 and shall come into force on 1st August 2001. (2) These Regulations extend to Scotland only. Amendment of the Plant Protection Products Regulations 1995 2. Regulation 2(1) (interpretation) of the Plant Protection Products Regulations 1995[3] shall be amended by substituting for the definition of "the Directive"-

(b) the Plant Protection Products (Amendment) (No. 2) Regulations 1997[30]; (c) the Plant Protection Products Amendment (Scotland) Regulations 2001[31]; and (d) the Plant Protection Products Amendment (No. 2) (Scotland) Regulations 2001;".
Revocation (This note is not part of the Regulations) These Regulations further amend the Plant Protection Products Regulations 1995 ("the 1995 Regulations"), which implement Council Directive 91/414/EEC concerning the placing of plant protection products on the market (O.J. No. L 230, 19.8.91, p.1, as read with corrigenda published in O.J. No. L 170, 25.6.92, p.40). The Regulations amend the definition of "the Directive" in the 1995 Regulations so as to implement-
(b) Commission Directive 2001/21/EC (O.J. No. L 69, 10.3.01, p.17) (as from 1st July 2002); and (c) Commission Directive 2001/28/EC (O.J. No. L 113, 24.4.01, p.5),
which add lambda-cyhalothrin, amitrole, diquat, pyridate, thiabendazote and fenhaxamid to Annex I to the Directive (regulation 2). Notes: [1] 1972 c.68. Section 2(2) was amended by the Scotland Act 1998 (c.46), Schedule 8, paragraph 15(3). The functions conferred upon the Minister of the Crown under section 2(2) of the European Communities Act 1972, in so far as within devolved competence, were transferred to the Scottish Ministers by virtue of section 53 of the Scotland Act 1998.back [2] 1973 c.51.
