FOOD, WALES

The Foot-and-Mouth Disease (Marking of Meat, Meat Products, Minced Meat and Meat Preparations) (Wales) Regulations 2001

  Made At 4.25pm on 9th May 2001  
  Coming into force at 5pm on 9th May 2001  

The National Assembly for Wales, being designated [1] for the purposes of section 2(2) of the European Communities Act 1972 [2] in relation to the common agricultural policy of the European Community, in exercise of the powers conferred on it by that section, makes the following Regulations:

Title, application and commencement
     1 These Regulations may be cited as the Foot-and-Mouth Disease (Marking of Meat, Meat Products, Minced Meat and Meat Preparations) (Wales) Regulations 2001; they apply to Wales and shall come into force at 5pm on 9th May 2001.

Amendment to the Meat Products (Hygiene) Regulations 1994
    
2. In - 

    (a) sub-paragraph (2) of paragraph 3A; and

    (b) sub-paragraphs (1) and (2) of paragraph 3B

of Part VI of Schedule 2 to the Meat Products (Hygiene) Regulations 1994[3] for "2001/172/EC", substitute "2001/356/EC[4]".

Amendment to the Fresh Meat (Hygiene and Inspection) Regulations 1995
     3. In sub-paragraph (3) of paragraph 9 of Schedule 12 to the Fresh Meat (Hygiene and Inspection) Regulations 1995( ) for "2001/172/EC", substitute "2001/356/EC".

Amendment to the Minced Meat and Meat Preparations (Hygiene) Regulations 1995
    
4.  - (1) The Minced Meat and Meat Preparations (Hygiene) Regulations 1995[5] are amended in accordance with this regulation and a reference to a regulation by number alone is a reference to the regulation so numbered in those Regulations.

    (2) In regulation 7 - 

    (a) omit paragraphs (1A) and (1B); and

    (b) in paragraph (6), for "2001/172/EC", substitute "2001/356/EC".

    (3) In regulation 8 - 

    (a) omit paragraphs (4A) and (4B); and

    (b) in paragraph (7), for "2001/172/EC", substitute "2001/356/EC".

EXPLANATORY NOTE

(This Note is not part of the Regulations)


These Regulations amend the Meat Products (Hygiene) Regulations 1994, the Fresh Meat (Hygiene) and Inspection Regulations 1995 and the Minced Meat and Meat Preparations (Hygiene) Regulations 1995 ('the amended regulations') in their application to Wales.

The amendments are consequence of Commission Decision 2001/356/EC of 4 May 2001 concerning certain protection measures with regard to foot-and-mouth disease in the United Kingdom and repealing Commission Decision 2001/172/EC, OJ No. L125, 5.5.2001. p. 46.

These regulations:

    · substitute references to Commission Decision 2001/172/EC for references to Commission Decision 2001/356/EC in the amended regulations; and

    · remove the prohibitions on the export of minced meat and meat preparations (and the corresponding exceptions) in the Minced Meat and Meat Preparations (Hygiene) Regulations 1995 .

The prohibition on export of minced meat and meat preparations formerly contained in regulations 7(1A) and 8(4A) of the Minced Meat and Meat Preparations (Hygiene) Regulations 1995 is now contained in the legislation implementing Decision 2001/356/EC (The Import and Export Restrictions (Foot-and-Mouth Disease) (Wales) (No.6) Regulations 2001).

A regulatory appraisal has not been prepared for these Regulations.
