MARINE POLLUTION

The Merchant Shipping (Oil Pollution Preparedness, Response and Cooperation Convention) (Amendment) Regulations 2001

  Coming into force 11th June 2001  

The Secretary of State for the Environment, Transport and the Regions, in exercise of the powers conferred upon him by article 2 of the Merchant Shipping (Oil Pollution Preparedness, Response and Cooperation Convention) Order 1997[1], hereby makes the following Regulations:

Citation and commencement
     1. These Regulations may be cited as the Merchant Shipping (Oil Pollution Preparedness, Response and Cooperation Convention) (Amendment) Regulations 2001 and shall come into force on 11th June 2001.

Amendment of Regulations
    
2. For paragraph 4(c) in the Schedule to the Merchant Shipping (Oil Pollution Preparedness, Response and Cooperation Convention) Regulations 1998[2] there shall be substituted:

      " (c) the reference in paragraph 2 above to sums received by the authority shall be read as including a reference to sums received by any subsidiary of the authority which are shown in the statement of accounts there mentioned (and paragraph 3 above shall be construed accordingly).".

EXPLANATORY NOTE

(This note is not part of the Regulations)


These Regulations amend paragraph 4 in the Schedule to the Merchant Shipping (Oil Pollution Preparedness, Response and Cooperation Convention) Regulations 1998 ("the 1998 Regulations"). They have been made in consequence of a defect in the 1998 Regulations, and are being issued free of charge to all known recipients of those Regulations. The Schedule to the 1998 Regulations provides for the meaning of "annual turnover".
