WATER INDUSTRY, ENGLAND

The Yorkshire Water and York Waterworks (Amendment of Local Enactments Etc.) Order 2000

 
  Made 28th March 2000  
  Coming into force 1st April 2000  

Whereas provision is made in relation to Yorkshire Water Services Limited ("Yorkshire") and The York Waterworks Limited ("York") in local statutory provisions;

     And whereas the Director General of Water Services has made a variation under section 8 of the Water Industry Act 1991[1] replacing York as a water undertaker with effect from 1st April 2000;

     And whereas by virtue of that variation Yorkshire will hold an appointment as the water undertaker for the whole of the area for which Yorkshire and York each hold appointments as water undertakers;

     And whereas with effect from 1st April 2000 York will transfer properties, rights and liabilities to Yorkshire by a transfer scheme under Schedule 2 to the Water Industry Act 1991;

     And whereas it appears to the Secretary of State appropriate for the purposes of the above-mentioned variation and transfer scheme that provision be made corresponding to provisions originally made by Schedule 26 to the Water Act 1989[2];

     Now therefore the Secretary of State, in exercise of the powers conferred upon him by paragraph 7 of Schedule 2 to the Water Industry Act 1991, hereby makes the following Order:

Citation, commencement and interpretation
1.  - (1) This Order may be cited as the Yorkshire Water and York Waterworks (Amendment of Local Enactments Etc.) Order 2000 and shall come into force on 1st April 2000.

    (2) In this Order - 
 

    "Yorkshire" means Yorkshire Water Services Limited; and
    "York" means The York Waterworks Limited.
Amendment of references in local statutory provisions etc.
2.  - (1) Any reference to York, or to the undertaking of York, in any local statutory provision and in any charges scheme made by York under section 76 of the Water Act 1989 or section 143 of the Water Industry Act 1991 shall have effect, subject to paragraph (2), as a reference to Yorkshire or, as the case may be, to the undertaking of Yorkshire.

    (2) Paragraph (1) only applies to any local statutory provision or charges scheme in relation to the area, things or persons in relation to which or whom that provision or scheme has effect before 1st April 2000.
