Whereas the Secretary of State laid the draft of this Order before Parliament on 19th January 2000; And whereas the said draft as so laid has been approved by resolution of each House of Parliament; Now therefore the Secretary of State in exercise of the powers conferred on him by sections 50 and 71 of the Competition Act 1998[1], hereby makes the following Order: Citation and commencement 1. This Order may be cited as the Competition Act 1998 (Land and Vertical Agreements Exclusion) Order 2000 and shall come into force on 1st March 2000. Definitions 2. In this Order -
Exclusion of vertical agreements from the Chapter I prohibition
(b) in other relevant land and relates to the imposition in respect of that land of:
(ii) obligations which correspond to those accepted by a party to the agreement in his capacity as holder of an interest in the relevant land.
(2) This article applies to a restriction which:
(b) is accepted by a party to the agreement in his capacity as holder of an interest in other relevant land and relates to the imposition of restrictions on the activity that may be carried out on, from, or in connection with the other relevant land which correspond to those accepted by a party to the agreement in his capacity as holder of an interest in the relevant land; or (c) restricts the freedom of a party to the agreement to create or transfer an interest in the relevant land to another person.
Withdrawal of exclusion etc. (This note is not part of the Order) This Order excludes land and vertical agreements, as defined in the Order, from the prohibition on anti-competitive agreements imposed by section 2 of the Competition Act 1998 (the Chapter I prohibition). The Order provides for power to withdraw the exclusion from a particular agreement, and that an agreement to the like object and effect between the same parties to an agreement from which the exclusion is withdrawn is not excluded. A Regulatory Impact Assessment has been prepared in relation to this Order.
