HEALTH (COUNTRY
OF ORIGIN OF BEEF) (AMENDMENT) REGULATIONS 2007

I, MARY HARNEY,
Minister for Health and Children, in exercise of the powers conferred on me
by section 54 (inserted by section 25 of the Irish Medicines Board
(Miscellaneous Provisions) Act 2006 (No. 3 of 2006)) of the Health Act 1947
(No. 28 of 1947) (as adapted by the Health (Alteration of Name of Department
and Title of Minister) Order 1997 ( S.I. No. 308 of 1997 )), after
consultation with the Minister for Enterprise, Trade and Employment and the
Minister for Agriculture and Food, hereby make the following regulations:

1. These
Regulations may be cited as the Health (Country of Origin of Beef)
(Amendment) Regulations 2007.
|
|
|
|
2. In these
Regulations, “Principal Regulations” means the Health (Country of Origin of
Beef) Regulations 2006 ( S.I. No. 307 of 2006 ).
|
|
|
|
3.
Regulation 2(1) of the Principal Regulations is amended—
|
|
|
|
(a) by deleting the
definition of “beef”,
|
|
|
|
(b) by deleting
footnotes 1 and 2,
|
|
|
|
(c) by inserting after
the definition of “authority” the following definition:
|
|
|
|
“ ‘caterer’ means any food
business operator involved in the catering trade, including hotels,
restaurants, public houses providing food, sandwich bars, canteens,
healthcare establishments, catering service providers and takeaway food
service outlets, which provide prepared beef directly to the final
consumer;”,
|
|
|
|
(d) by substituting for
the definition of “country of origin” the following definition:
|
|
|
|
“ ‘country of origin’ shall
include all those countries in which the animal was born, reared or slaughtered
as referred to in Regulation (EC) No. 1760/20001 of the European
Parliament and of the Council of 17 July 2000 establishing a system for the
identification and registration of bovine animals and regarding the
labelling of beef and beef products and repealing Council Regulation (EC)
No. 820/97;”

and by adding the following footnote thereto:
|
|
|
|

(e) by deleting the
definition of “food business operator”,
|
|
|
|
(f) by deleting
footnote 3,
|
|
|
|
(g) by substituting for
the definition of “prepared beef” the following definition:
|
|
|
|
“ ‘prepared beef’ means
beef, within the meaning assigned to it by Regulation (EC) No. 1760/20001
of the European Parliament and of the Council of 17 July 2000, which has
been cooked or otherwise prepared for human consumption in the caterer’s
establishment and beef within that meaning which has been bought in cooked”.

4.
Regulations 3 and 4 of the Principal Regulations are amended by substituting
“caterer” for “food business operator” in each place where it occurs.
|
|
|
|
5.
Regulations 9 and 10 of the Principal Regulations are amended by
substituting “prepared beef” for “beef or prepared beef” in each place where
it occurs.
