I, SÍLE DE VALERA, Minister for Arts, Heritage, Gaeltacht
and the Islands, in exercise of the powers conferred on me by section 32 of
the Wildlife (Amendment) Act, 2000 ( No. 38 of 2000 ), with prior consent of
the Minister for the Marine and Natural Resources, make the following
regulations:

1. These
Regulations may be cited as the Wildlife (Fish and Aquatic Invertebrate
Animals) (Exclusion) Regulations, 2001.
|
|
|
|
2. Each
animal of the species of fish mentioned in Part 1 of the Schedule to these
Regulations and each aquatic invertebrate animal mentioned in Part 2 of that
Schedule are specified for the purposes of section 32 of the Wildlife
(Amendment) Act, 2000 ( No. 38 of 2000 ).

EXPLANATORY NOTE
|
|
|
|
(This note is not part of the Instrument and does not purport to be a
legal interpretation).

|
|
1. The Wildlife
(Amendment) Act, 2000 includes new definition of “fauna” and “wild animal”,
which extends the scope of the Wildlife Acts to cover fish and aquatic
invertebrates.
|
|
|
|
2. The
effect of these regulations is to declare certain species of fish or aquatic
invertebrate animal to be excluded from the provisions of the Wildlife
(Amendment) Act, 2000 .
