1 A person who is required to pay stumpage on timber harvested in the Merritt Forest District under a non-replaceable timber sale licence entered into under the Forest Act must pay, in addition to the stumpage, a levy on that timber of $8.28 per m3, if
(a) the licence was entered into under section 23 (1) (c) of the Forest Act, on or after January 15, 1999 and before the coming into force of paragraph (b), or
(b) the licence states that the timber
(i) is required to be utilized, and
(ii) is part of the 550 000 cubic metre increase in the allowable annual cut made by the chief forester in the rationale titled "Merritt Timber Supply Area Rationale for allowable annual cut (AAC) uplift determination", signed December 17, 1998 and made effective January 1, 1999.

2 The levy is payable when the stumpage is payable, and must be paid to the collector of the stumpage.
3 The levy must be paid, under the Forest Stand Management Fund Act and section 5 of the Special Accounts Appropriation and Control Act, into the Forest and Range Sub-account of the Forest Stand Management Fund special account.
4 This regulation is repealed June 1, 2002.
