Performing the point 4 of the Decision of Council of Ministers No. 36, date 31/01/94 on "Giving of professional licenses in the sector of forest and pastures", changed by the Decision of the Council of Ministers No. 330, date 26/06/95 "For a change on the Decision of the Cc Ministers No. 36, date 31/01/94', the Directorate General of Forests and Pastures issues that:

1. High experts who want to exercise the private activity of studious, plan implementation; and middle technicians who want to exercise the activity implementation in several parts of the sector of forests and pastures, have the request the professional license as physica1 person, introducing documents according to Bound 1.

2. Persons who wants to exercise pri0vate activities in defined fields, have the right to do a request in order to take professional licenses as juridical persons introducing documents according to the Bound 2. They are obliged to include in the subject the physical persons that are high specialists or middle technicians, which should have their professional licenses according to the Bond l.

3. Foreign societies, which want to execute activities in diverse fields in the sector of forests and pastures, have the right to make the request to take professional licenses as juridical persons, introducing documents according to Bound 3.Request to take professional licenses are directed for the following fields:

• Forest management
• Reforestation
• Forest improvements
• Systematization in mountains.
• Roads in forests
• Management of flora
• Protection from diseases, damages and fires
• Management of pastures and meadows
• Building and repair of works in order to insure drinkable water in pastures and meadows.
• Activities and respective criteria for each field are defined and approved by the Directorate General of Forests and Pastures.

5. The professional license for the physical persons are given according to the specialization settled in their diploma, for general specialists it is fixed not for more than five activities.

To take the professional license, the physical person must submit the written certification about the work that he/she had done, taken respectively at the Directorates for Forest Services where he/she has executed the activity/activities, or at institutions or authorities that have approved his/her studies or projects.

For the specialist that have been working near ex-Enterprises for Exploiting of Forests and Second Productions (which do not exist more), who can not take the needed documentation about the work that they have done before, it will be taken in consider the work book.

6. Physical person is allowed to take part only in one juridical subject. In special cases, with approval of General Director, one physical person is allowed to be component of more than one juridical person.

Juridical representative could be technical director of his subject, if he is a high or middle specialist and he have to be equipped with professional license as a physical person.

7. Requests, together with the relevant information, are accepted near the General Directorate of Forests and Pastures till the 10th day of the last month of every quarter.

8. Have not the right to take professional license to exercise private activity as juridical and physical persons, persons who actually work near Directorate General for Forest and Pastures, Directorates for Forest Services of districts, Forest and Pastures Research Institute, Agricultural University of Tirana as well as the specialists who actually work in other governmental institutes.

Those persons are not allowed to became representative of juridical subjects, when they take part in auctions or tenders, which are taken to do several works in forests and pastures.

9. Juridical and physical persons, who are equipped with professional license, are registered in the basic register of the Committee for giving of licenses. Once taking the professiona1 license each juridical or physical must be equipped with all the other needed documentation, conform the legislation in force.

10. To take the professional license near the Directorate General for Forests and Pastures, physical person must pay 1000 Lek, juridical person must pay 3000 Lek, while for the renewal of licenses they must pay respectively 500 and 1500 Lek.

11. Professional license is available for one year of activity. It can be renewed with a stamping within the last month of the year during which the license is available.

12. Each quarter, one month before the commission gathers, the respective DFS-s give their opinion if is worth to renew the contract for each juridical or physical person, whose license is expiring. The license will not be renewed to the subjects that has not exercise it for two successive years.

13. Subject, whose license has not been renewed, has the right to exercise the licence till the expiring date, but it looses the right to take part in other auctions and tenders from the date that the license expires.

14. On base of motivate proposals from DFS-s, the Committee shots up the license to the juridical and physical persons, when they have infringe lows and sublaws, or if they are not trusted partners, as result of not respecting contractual obligations.

15. If the juridical and physical subjects want to change their fields of activities, they should submit a request to the commission that gives the professional licenses. When the subject wants to change the technical director, attached to the request the subject should submit the director's who lives statement and supporting documents of the new director.

In these cases the rates are the same as for the renewal of licenses.

16. The request documents for professional licenses should be original, typewritten. Photocopies should be notarized.

17. Order No. 1. date 7.02.1996, is abrogated .

This regulation enters in force immediately.
