Definition
1 In this Regulation, "Act" means the Environmental Protection and
Enhancement Act.
Provision of information
2(1) Subject to subsection (2), within a reasonable time after receipt of
a request in writing for a document or information referred to in section
35(1) of the Act, the Director or other person in charge of keeping the
document or information shall
(a) make the document or information available for inspection by
the person making the request during normal business hours at the location
where it is kept, and
(b) provide one copy of the document or information free of charge
to the person making the request.
(2) Where a request relates in whole or part to information or documents
referred to in section 35(1)(a)(iii), (iv) or (v) of the Act, the Director
or person in charge may refuse to comply with subsection (1) unless he is
satisfied that the person requesting the document or information has first
made the request of the appropriate approval holder or certificate of
variance holder and that the request
(a) was refused, or
(b) was not complied with within 30 days after the request was
made.
(3) Where a person makes a request under subsection (1) and the Director
or other person in charge is of the opinion that the document or
information has already been provided to a group, organization, association
or other body of which the person is a member or with which the person is
otherwise affiliated, the Director or other person may refuse to comply
with subsection (1).

Minister's discretion
2.1 Where the Minister decides under the authority of section 35(3) of
the Act to disclose information in the possession of the Department to the
public, the Minister may do so in any form and manner the Minister
considers appropriate.

Form of request
3 A request under section 2 must be made in a form acceptable to the
Director and must contain the following information:
(a) the name, mailing address and telephone number of the person
requesting the document or information;
(b) the details of the document or information requested;
(c) in a case to which section 2(2) applies, the date of the
request made to the appropriate approval holder or certificate of variance
holder.
Repeal
4 The Release of Monitoring Information Order (Alta. Reg. 403/84) is
repealed.
Coming into force
5 This Regulation comes into force on September 1, 1993.
